    Yes your insurance rates go up,your ticket goes on your name nothing to do with the car at all.. The insurance companies Re-Run your Drivers License every time your Term is up which is usually every 6months and when they do if you have new tickets on your license then it Might go up but if there s old tickets that went off your record cause 3years then a tickets gone then your insurance can even go down.If you need more information then go to your DMV office of your state.

    Q. If a child is at fault in an accident can they sue for medical bills?
    we were involved in an accident with a bike that was driven by an 11 year old girl. the police cleared us of any wrong doing and stated that the girl was at fault. now they have a lawyer and have contacted the insurance company looking for payment on medical bills... how can we be responsible when it was her fault? our insurance company said that since she is a minor she cant be held for her actions...what about her parents? what options do we have? i don't want my rates to go up because of someone else...any advice?


    The police do not make the final decision as to liability. The police decide whether anyone did anything sufficiently illegal to justify a ticket for a moving violation. Liability is determined by a court or by mutual agreement between the lawyer and the insurance company, not by the police. If neither you nor your insurance company pays, then they can sue, which means only that they are asking a court to decide, not that you have to pay. At that point, your insurance company can settle, or it can go to court, and let the court decide. In any case, your insurance rates can go up even if you were not at fault. Many insurance companies base their rates on the total number of accidents, even the ones that were someone else's fault.

    Q. Cause and effect....gas prices/new drivers (details)?
    with the ever soaring price of fuel, i do not believe the new drivers coming out of high schools every year are going to have very much practice time behind the wheel anymore. i believe this is going to lead to an entire generation of children who are pretty bad drivers (practice makes perfect). of course this will also have the effect of raising the insurance rates of everyone as accident rates go up. i also think that cars of the future will come with more "idiot" controls (which have actually made accidents go up, not down). things like winshield wipers that come on when it rains, buzzers than sound when your too close to another vehicle, seatbelts that buckle for you, and cars that can park themselves. do you see anymore cause and effects that are along the above lines of thinking? to the person who stated i had no proof that the "idiot" gadgets in modern cars caused more accidnet, actually there is proof. ask anyone in the insurance industry (they keep great statistics). i also watched a very interesting 20/20, or 60 minutes, or some such show about that topic. basically it boiled down to this....all the saftey gadgets made drivers more relaxed, and more complacent, and not nearly as attentive a driver as they should be. so all the gadgets, while helping people to survive car accidents better, and with fewer injuries, have actually lead to the increase in accidents. my kids think the tractor is great....as long as its not running. they like to play on the tractors, and just generally cause all kinds of mischief on them. but start one of those old johnny poppers up, and my kids run away! completely terrified of them. i probably shouldn't admit this, but i encourage that behavior totally. i'd much rather have the kids run from the tractors, than be brave, and approach one while it's running. it would be horrible to run a kid over! have you read enough of my postings/replies to realize by now i'm talking about goat kids? ~lol~ we have no human children, but our farm is possitively crawling with kids!


    With decreased driving, and with joy-riding unaffordable, accidents will go down and the cost of insurance with them. In the long-run, new drivers my get the opportunity to practice in simulators -- but that won't help current drivers. But no one in my family has reduced miles due to gas prices. We only drive when we need to anyhow. When my sons were learning to drive, they drove places we needed to go mostly. There were only about three times each that they went driving for practice. That's maybe an extra 300 miles, roughly $30 in gas over 6-months. We'll see more people working from home, or living closer to work. More public transportation. Things will change but many people will like the changes. (Once people learn how easy it is to commute by bus or train they don't usually go back to driving in commute traffic.)

    Q. Need serious advice on an auto accident settlement, lawyer is giving vague answers to me, not really helpful..?
    had a very bad car accident summer of 2007. have had shoulder surgery for a torn rotator cuff, have had surgery on each arm for nerve damage due to compression from impact onto steering wheel, still having neurological issues from 5 herniations in my cervical spine. c2, c3, c4, c5, c6 are all severely herniated, c4 and c5 are pinching into my spinal column and i am experiencing periodic numbness in my body, not loss of control of my body but just a pins and needles feeling in parts of my body from this herniation. i am going to have neck surgery because of this, surgery is set for march of this year...the driver that hit me ran a red light and sideswiped me. she is a highschool student that lives in her parents house...she is 18 and lives in her parents home because she was going to be a senior in highschool that fall....my lawyer called and told me he has recieved a call from the girls parents insurance company, whom she is insured with under her parents policy...they have a 50,000 policy...the insurance company have offered the full 50,000 and want her to settle. i asked the lawyer what my options were because i have such devistating injuries, can i go after their assets, or home owners insurance beings she was a driver under the parents and they dont have low insurance...they own a 430,000 dollar home, the father drives a 50,000 truck, the mother drives a new caddillac escalade, he owns a large trailer that hauls vehicles...the trailer is very valuable, over 20,000 dollar enclosed trailer. the lawyer says that i can get the 50,000 policy and cant go after homeowners but my question is, i am told that when a child of a parent is living in the home and driving, a parent should have an umbrella policy in case the child driving causes a devistating auto accident that results in severe injuries, so they cant lose their home....my lawyer seems really eager to settle this case and i haven't even had my neck surgery yet...he says my own insurance pip that i have will cover all surgeries that i need and give me all the medical care that i still need until i fully recover, but i am very angry and extremely upset because my injuries are worth way more than 50,000 dollars minus the lawyers 1/3 fee...i have had several surgeries and i am going to have a fused neck because of surgery that is needed, and my neurological health is still at risk...i want to know my options, i am afraid to go to another lawyer to ask advice but i need to know what i should do so i don't screw myself out of compensation...i live in northern new jersey and i want to know if anyone knows what my options are....can i get the 50,000 off of their policy and then file a civil suit in court against them and go after all of their assets and when i win in court because she is found to be 100% negligent because she ran a redlight and hit my car at a high rate of speed 60 mph side impact...when i win would they be ordered to pay by a judge and all of their assets, including their home or whatever have a lein put against it??? i dont want to come across as a snake here but i am really in a bad position because i am permanately disabled from this accident and lost a career and a large part of my life as i knew it and i dont want to settle this out for peanuts....thanks.. just looked at all paperwork and girl that hit me was not 18...she was only 17 at the time of the accident. she was a 17 year old senior in highschool....i want to know if her being under 18 changes anything with the fact that she is a minor and still the responsibility of her parents....does this make my case better or does it stay the same..thanks

    I would say your lawyer is a sleaze -- some criminal lawyers often used to do this when they were paid from the public purse -- they told all of their clients to plead guilty. Until the system was changed, this way they got 10 clients to plead guilty in about 50 minutes and got 10 day's worth of fees for doing no real work. In this case, your lawyer is assessing that if he puts in more work, the settlement amount may go up, but his marginal return will be far lower for the amount of time he puts in. I can't say for sure though... it may legitimately be that there was no umbrella policy for the parent's insurance - definitely INSTRUCT your lawyer to have a look at the parent's policies and INSTRUCT him to explain everything. He works for you, even if he is on a contingency. If there is anything you don't understand, crawl up his ass until he has explained it properly and look at the documents yourself as he explains them. Also, I suspect you have, but if not, begin the court proceedings so the limitation period is saved. Best of luck. Re: going after parent's assets, I'm afraid that you can't do this unless you can prove they were negligent in some way. If the girl has any savings, though, you could go after those (and any value left in her car). ...but, although not legally required, If the parent's are loaded they will pay the excess rather than leave it on their daughter's record that she is a judgment debtor - if you take this to trial and win, that will follow her until bankruptcy or she's rich enough to pay you off from her own pocket but that could drag this out for years/decades. but yes, if your lawyer doesn't straighten up, consult someone else, even for a second opinion.

    Q. Is this wrong or is it just me?
    this has really been irritating me and i want to get it off my chest. at the place where i work, one of my co-workers was injured in an accident while test riding a new motorcycle. he's disabled now and can't work anymore. he got a large settlement from the person who hit him and is getting worker's comp. what irritates me is that he then turned around and sued the business and the insurance company that insures the business! he's gotten close to 2 million dollars. now, he and his wife has a small child with brain cancer. they are not using any of this money towards her. they are doing holistic medicine and doing fund raisers to get money for her. they have health insurance that would pay for it. they've also spent the money on adding on to their house, buying a studio for the wife's photography business, and other unnecessary things. and now he wants to still be buddy-buddy with other workers here, even though his lawsuit has caused all of the insurance rates to go up. is this wrong to be irritated or not? thanks for reading through my rant. @ time to think: yes this is in the united states, but i hardly think that has anything to do with it. i wasn't asking for your opinion of americans, just an opinion in this matter, regardless of nationality. (and the guy is british, by the way.)


    No not wrong. It's the result of graduating more lawyers yearly than doctors. It's also the result of dumb people like your former co-worker doing stupid things and wanting to blame someone else. Undoubtedly the next target will be the maker of the motorcycle for the idiot's lousy riding ability.

    I think all health care should be UHC so we pay for it out of our taxes so there are no premiums so this shouldn't be an issue.

    Where is the justice in a man spending his life in prison for a crime he was accused of but actually did not commit. There is none! The point?!! ...Who said life was just and fair in this world of greed and power hungry business ran by men and women.

    Of course. Women are more costly to insure than men. Men don't have high risk pregnancies, nor do they require regular, ongoing gynecology services. It's for this same reason that individuals (both male and female) with a history of car accidents pay more for car insurance. That isn't "discrimination", that's basic math. ~Dr. B.~

    Q. Why do you drive an suv?
    i know it's a free country and you can spend your money anyway you want. i want more detailed answers than that please. a recent study or insurance statistics by the partners for child passenger safety looked at accidents involving 4,000 children in newer suv's and found the rates to be almost identical to conventional cars. they found that the extra weight provided enhanced safety (reducing injuries by a third) but the tendency to roll over completely offset this.


    We have side air bags, driver side air bags, and passenger side air bags. It feels safer. I think you are safer in an SUV because it is a bigger vehicle and the chances of getting injured by colliding with another SUV are smaller than the chances of getting injured by collinding with an SUV when you are in a regular car. Some do roll over, but you can't drive them like a maniac. There is a site with the list of worst roll-over resistant SUVs. Honestly, I got it because I have children and everywhere I go I'm carrying bikes and sand toys and diaper bags and a stroller. I don't even know what people did before these. I guess they had to drive mini vans. :(

    Q. Teen doesn't want to drive? what should i do?
    my 18 year old daughter has no desire to drive. in my state you can get a learner's permit (must have for a year before getting license) at 15, but she doesn't even have this and won't get it. i let her get a state id card so she'd have something to show if needed. her sister will be turning 17 in a few months and is the opposite. she has had her learner's permit since the middle of her 15th year, and wants to go try to get her license on her 17th birthday. she can't wait! my older daughter helped her study to get her learner's permit and the two are sitting around going over the drivers handbook getting my younger daughter ready for her upcoming test. but the older one won't even try to get hers, even though she knows the needed info. is this normal at all? she is a very serious, reserved, intelligent child and worries a lot. she doesn't want my insurance rates to go up or to be responsible for accidents. however, i can't help but feel she shouldn't be this way. what can i do?


    I would sit down with her and talk to her about it, maybe she thinks she will fail and seens her younger sister is so smart that will make her look bad. She may also not want to increase you insurance rate like you said, intentionally meaning she doesn't think she will be any good at it. Also, drivers license means responsibility and requires maturing...maybe she isn't ready for that yet.
