Q. My son had an accident and the insurance company wants to "total" his car. can i force them to repair it?
my son had an accident in his 2001 ford mustang last sunday. our insurance company wants to total out his car. i am afraid that it will not give him what the car is really worth and we will be stuck making up the difference. even if the insurance company does pay full value, we will have to come up with a down payment for a new car for him and go through all the hassle of shopping for it. is there any way we can force the insurance company to repair his car? if not, how can we be sure to at least get full value for the car?


If you want to keep the car it will have a salvage title. The insurance company will give you blue book value for it, not what it will cost to fix it. Find cars for sale locally that are comparable to his and give a list to your agent. Be firm in saying you want the amount it would cost to replace his car. Insurance companies want to settle things quickly, if you have something specific and reasonable you want they'll usually agree just to have it over. I totaled my Mustang and they wanted to give me $3500 for it. I found several for sale nearby in the $5500-6500 range and they ended up giving me $6000 so I'd go away.

In the USA,Yes he should be covered.........but..... If your Son lives in your household you should have already notified your insurance company of the fact that he has a drivers license. Read the rules: Insurance companies want to know about all licensed household members (it does not matter if they are young or old) so they can calculate their potential risks for having you and these drivers covered by your insurance policy. When you purchase liability insurance (which every auto insurance policy has), there is a law that < REQUIRES > insurance companies to cover all household members who have a drivers license. Most all insurance companies will require that you either add licensed household members to the policy or exclude them. This is because as household members it is assumed they have access to your vehicles and may drive them at any time. These drivers are thus a risk/rating factor to be taken into consideration. Many state laws require it, and your policy contract has in it terms that say you must inform them of licensed drivers dwelling in your household, so that they can add him as a driver to your policy and rate accordingly or exclude him. Excluding anyone from your car insurance would mean that you are not paying extra on your policy to have him/her as a driver and thus they are not extended any coverage by your insurance policy if they were to drive your car and be in an accident, even if it were an emergency situation. So most insurance companies will require you to place the non-relative household member on your insurance policy as a driver if he is licensed. All licensed household members are normally required to be listed as a driver or excluded on an auto insurance policy by the insurance provider. If you have a licensed household member, whether a relative, roommate, etc, the insurer believes that the person will have access to your vehicle and thus is a rating factor that should be on your insurance policy. If the person really is not going to drive the insured vehicle then there should not be an issue with excluding them. Without you signing off on the exclusion the insurance company cannot really believe that a licensed household member may not drive your car. State laws differ however. Typically, insurance companies are allowed to use classifications that reflect a possible exposure for liability on the part of the insurer, in the event that bodily injury or property damage occurs due to the operation of the vehicle by anyone in your household. The perceived risk for non-household members by an insurance company is different and that is why you can normally let a friend that does not live with you borrow your vehicle without adding him or her to your policy. A friend may occasionally borrow your car and be covered by your insurance because they do not have regular access to your car and thus are not rated as a risk factor on your policy. If you do have someone outside of the household that regularly drives your car then normally an insurance carrier usually would also want this person listed an occasional driver so they would be properly covered in an accident.

our car insurance paid accidental death for our son but it came in trust for our son? we dont have a trust so how do we cash it?


It becomes part of your son's estate. It is handed through the probate process. Contact your local probate court for instructions on how to set up an estate for your son. I am sorry for your loss.

Q. How do i know what to settle for from an accident where son broke his ankle, insurance is ready--help!?


Just an FYI - minor settlements in most states need to be approved by a judge. This is usually called a "friendly suit". The adjuster can walk you through the process. If the judge does not feel that the settlement is fair and reasonable, he/she will make a recommendation which can be accepted or rejected. $25-$30k(as suggested by Adjuster) for a fractured ankle is in the ballpark, but it certainly depends on the severity of the fracture and if permanency is expected. If this was a hairline fracture, the settlement could be much less. If open reduction internal fixation surgery was needed, it could be much higher.

i am going to give my old car to my son as a gift. he lives in boston and i live in d.c. he is an adult and has his own insurance policy on his car in boston. he would drive the gift car from va to ma. say on the road he would have an accident. would the incident be covered under my insurance policy, or his, or neither? do we need to do anything before his driving my car back to his home?


He needs to get the title switched into his name. Then purchase 30 day tags to drive it back home. He should also contact his insurance agent about coverage.

Q. Son in auto accident with no insurance, please help, we need guidance?
my 19 year old son had no insurance on his vehicle when he was in a car accident. the vehicle was in my husbands name. my son was found at fault for his brakes giving out. a person was injured in the other car. my son already went to court for the no insurance violation (michigan). we received a letter for my husband and son from an attorneys office for the injured party. they want us to state whether we had insurance at the time and if so, with who. an accident report was already done, stating there was no insurance. my husband had insurance on our vehicles that we drive, but we did not have the vehicle my son drove insured. we left that to our son. do we give the attorney our insurance information from our personal vehicles, that were not involved in the accident? also will we be sued? we have no money or assets that amount to anything. i work minimum wage and my husband is unemployed..we struggle. my son is in school and has no assets.

Q. Our 17 year son was killed in an airplane accident. received small settlement from insurance, is that taxable?
the insurance policy is from the flight school of aircraft involved in accident. small settlement of $100,000., after attorney fees from civil suit (which was dropped), has brought that down to half which was received. we are wondering if we need to paid state or federal taxes on settlement, and if so, on what figure. any information would greatly be appreciated, thank you.


Sorry to hear of your loss. You mean...your attorney takes about half of what you could have gotten on your own (the full $100,000) without an attorney, and your attorney can't give you this answer. Oh. I bet he could for another 'small fee' If you son was flying as a student or a newly licensed low time pilot, and depending on what state you are in, the flight school's insurnce should have been very up-front and offered it all up on the table from the get-go.

Q. Would my sons school have accident insurance to cover repairing the tooth he broke at school?
a boy at my sons school knocked him down and caused my son to chip his tooth on this boys head. as a dental assistant, i know what will need to be done to repair the tooth. of course, my boss would do the work for free, but i don't feel that he should have to pay for the cost of the materials. i have been told that schools have accident insurance to cover things like this. is that true? the reason i ask, is that i had a child come in last year that had broken a tooth at school and the school paid for it to be repaired. i don't know that this kids parents could be made to pay if it was indeed an accident. like i said, since i work for a dentist, getting it fixed is no problem, but someone has to pay for the cost of the materials and i don't think it should be my boss even though i know he would do it for me.


I don't see why the school should be responsible for something an individual child did. I would handle the situation with the other boy's parents IF the child knocked him down on purpose. Accidents happen (which I realize is why people have accident insurance), but if the school wasn't being negligent, I don't see bothering with getting the school to pay for it. Besides, can you imagine all the red tape you'd get tangled in trying to get the insurance to cover it?

ok - so it was this lady's fault, smashed right into him. she’s admitted was her fault and she has full insurance, my son only has 3rd party. both doors and pillar damaged (maybe structural as well) it’s not an expensive car, my son is 17 – first car, couldn’t afford a flash one – anyhow, so i would think the repairs would outweigh the cost of the car. so does insurance only pay out the market value only, or market value plus a bit more, or trade in value… what could i expect as i’ve never dealt with insurance before, just heard they screw everyone over :-( thanks. what i mean about 'extra' is we've just spent a grand on it in the past 4 months, work done and new radiator etc....


With what I know about the situation I think the insurance will only give you what the car was worth at the time of the wreck. The total for the car will be subjective and the insurance company will try and give you least amount possible for the value of the car. I would do my research on the total value of the car and be ready to fight for that number.
